BUSINESSES AT RISK OF BEING NAMED AND SHAMED

A local solicitor is warning that businesses are at risk of being named and shamed under recent changes to employment laws. Michael Shroot, Head of Employment at Woodcocks solicitors and based in Bury, says that the public will now be able to access the records of all businesses that fail to pay up when they lose at Employment Tribunals.

Under the new laws, which came into force on 1st April, tribunal awards and ACAS settlements can now be enforced as effectively as if they were County Court Orders.   This is part of the Government’s agenda to highlight employers who fail to pay up when they lose Employment Tribunals.

Michael, who is a specialist employment solicitor and the Head of Employment Law Department at Woodcocks solicitors, (based in Bury), says: “Many businesses ignore tribunal orders or do not take them seriously enough because they don’t believe they are as effective as County Court Judgments.  “The new laws mean the register of Judgment Orders and Fines that is searched by members of the public and credit reference agencies will now also have on it recorded fines made by tribunals.   “With this information being made public for the first time, it can threaten an organisation’s reputation.  “These changes make it more important than ever for businesses to try and avoid ending up in such a situation.” With tribunal claims increasing steadily and the value of those claims also rising, the effect of an award against a company could be disastrous both financially and publicly.   Michael adds: “Now is the time for any business to take employment advice to avoid finding themselves facing an Employment Tribunal.”
