PROFILE ON OUR PERSONAL INJURY DEPARTMENT
Woodcocks have a vast well of experience to draw upon within our Personal Injury Department, with our holistic approach to accident claims meaning that we first and foremost ensure that our clients receive the appropriate treatment as quickly as possible and secondly (where appropriate) interim payments are received.
Based at our Bury Office, the Partner in charge of the department is Berin Jones. Berin joined the firm in September 1991 as a Trainee Solicitor and qualified in 1993, attaining the position of partner in 1999. Berin has extensive experience in handling high value claims where there has been significant disruption to people’s lives in association with serious injuries such as brain damage, amputations, serious work related conditions such as vibration white finger and other serious injuries. An active father of two, Berin is a keen runner and a keener Manchester United fan.
An accomplished team who have a great deal of expertise in the area of personal injury backs Berin. Solicitor Catherine Hamilton joined the firm in 1996 as a trainee after studying at Oxford and completing her Legal Practice Course at the College of Law in York. Catherine deals with all types of personal injury claims including Criminal Injuries Compensation. Pam Roberts is a Legal Executive at Woodcocks, dealing in particular with claims arising from industrial accidents.
One of the principles that is actively encouraged Woodcocks is the principle of rehabilitation. Berin and Catherine are members of the Association of Personal Injury Lawyers (APIL) that promotes rehabilitation. Rehabilitation can include arranging physiotherapy for clients. It is suggested that the earlier physiotherapy is obtained the more beneficial the treatment is and the quicker the results. Woodcocks can put clients in touch with private physiotherapists, or psychotherapists for those suffering from psychiatric reactions, with the cost recovered in full from the Defendants. Clients find this to be of a great benefit and the vast majority believe that it greatly improves their condition. In more serious cases where people have difficulty living in their current home, Woodcocks can help in looking at ways of adapting the property to ensure that people can stay in their homes. The other role of a personal injury lawyer is to secure for the client the most favourable settlement and ensure that they get fair and adequate compensation. This is not just for someone’s injuries and past losses but also to try and quantify future needs and losses.
Many people are put off pursuing a personal injury claim because of the growth in a “claims culture”. Many lawyers (including Woodcocks) like to distance themselves from this end of the market.
The most frequently asked question by any client when first attending an appointment is “How much will it cost?”. If you are unfortunate to sustain injuries in an accident, it would be prudent to seek legal advice immediately. You are likely to be called by insurers of the other party offering to “sort you out” themselves. This is definitely not in your best interests and constitutes a conflict of interest.
